A proposed settlement in a class action lawsuit concerning the prices of digital games sold via the Sony PlayStation Store may impact your rights. The lawsuit names Defendant Sony Interactive Entertainment LLC (“Defendant”). The case is titled Caccuri, et al. v. Sony Interactive Entertainment LLC, Civil Action No. 21-cv-03361-AMO (N.D. Cal.) (the “Action”). Pending in the United States District Court for the Northern District of California, San Francisco Division (the “Court”), the Action alleges that the Defendant infringed upon federal antitrust laws and various state laws. The Plaintiffs claim that the Defendant unlawfully stifled competition and monopolized the market for Sony digital games, leading to consumers paying higher prices for certain digital games than they otherwise would have on the PlayStation Store. The Defendant denies any wrongdoing and asserts that no Plaintiff or potential class member suffered harm due to its conduct. The Court has made no determination regarding the Defendant’s liability.
The Court has granted preliminary approval to the proposed settlement between the Plaintiffs and the Defendant (the “Settlement”). This Settlement provides for a payment of $7,850,000 (the “Settlement Amount”) to settle the claims of the Plaintiffs and Settlement Class Members against the Defendant. A hearing has been scheduled for the Court to determine whether to approve: (i) the Settlement; (ii) the plan for distributing the Settlement Amount to Settlement Class Members; (iii) the request by Lead Counsel for attorneys’ fees, costs, and expenses from the Settlement Amount; and (iv) the request by Lead Counsel for service awards for Messrs. Agustin Caccuri, Adrian Cendejas, and Allen Neumark from the Settlement Fund or the Attorneys’ fees (the “Fairness Hearing”). If the Settlement receives approval, it will resolve all claims in the Action. The Fairness Hearing is set for October 15, 2026, at 2:00 p.m., before Judge Araceli Martínez-Olguín at the United States District Court for the Northern District of California, 450 Golden Gate Avenue, San Francisco, California 94102.
Who Is Included in the Settlement Class?
You may qualify as a member of the settlement class in this Action (the “Settlement Class”) and be entitled to compensation under the Settlement if you purchased one or more Sony video games through the PlayStation Store for which a game-specific voucher (“GSV”) was available at retail before April 1, 2019. Additionally, at least 200 GSV redemptions for the game must have occurred prior to April 1, 2019, and the post-discount price must have increased by at least fifty cents when comparing the period from January 1, 2017, to March 31, 2019, against the period from April 1, 2019, to December 31, 2023. A GSV is defined as a physical voucher or an electronic code bought from a non-SIE retailer that allows a PlayStation user to download a specific game from the PlayStation Network.

Your Rights and Options
DO NOTHING: You will remain a member of the Settlement Class if you do not submit a request for exclusion by July 2, 2026. By taking no action, you stay in the Settlement Class and will be bound by any releases, judgments, and decisions issued by the Court in this Action, including rulings on the Settlement.
EXCLUDE YOURSELF FROM THE SETTLEMENT: To opt out of the Settlement Class, you must submit a written request by July 2, 2026. If you choose to exclude yourself, you will not be bound by any releases or future decisions, judgments, or orders from the Court. However, you will also forfeit the right to share in any distribution of the Settlement Amount from this lawsuit. You will retain the right to sue the Defendant based on the claims and factual allegations that were or could have been asserted in this Action.
OBJECT TO THE SETTLEMENT: If you wish to object to all or part of the Settlement, the Plaintiffs’ request for attorneys’ fees, or the reimbursement of costs, expenses, or service awards for Messrs. Agustin Caccuri, Adrian Cendejas, and Allen Neumark, you must serve a written objection by July 2, 2026. If you intend to speak in person at the Fairness Hearing, you must file a written letter of objection and/or a notice of intention to speak, along with a summary statement, with the Court and Lead Counsel by October 1, 2026.
